潮南区峡山科技工业园

土地登记资料公开查询办法

第一条 为规范土地登记资料的公开查询活动,保证土地交易安全,保护土地权利人的合法权益,根据《中华人民共和国土地管理法实施条例》,制定本办法。

第二条 本办法所称土地登记资料,是指:

(一)土地登记结果,包括土地登记卡和宗地图;

(二)原始登记资料,包括土地权属来源文件、土地登记申请书、地籍调查表和地籍图。

对前款第(一)项规定的土地登记结果,任何单位和个人都可以依照本办法的规定查询。

第三条 本办法第二条第一款第(二)项规定的原始登记资料,依照下列规定查询:

(一)土地权利人、取得土地权利人同意的单位和个人有权查询其土地权利范围内的原始登记资料;

(二)土地登记代理机构有权查询与其代理业务直接相关的原始登记资料;

(三)国家安全机关、公安机关、检察机关、审判机关和纪检监察部门有权查询与调查、处理案件有关的原始登记资料。

第四条 县级以上人民政府国土资源行政主管部门(以下简称查询机关)负责土地登记资料的公开查询工作。

查询机关根据工作需要,可以委托有关单位具体承办土地登记资料的公开查询事务。

第五条 查询机关应当逐步建立土地登记资料信息系统。

第六条 单位和个人(以下简称查询人)查询土地登记资料,可以自己查询,也可以委托代理人或者土地登记代理机构查询。委托他人查询的,应当出具授权委托书。

境外委托人的授权委托书应当按照有关规定经过公证或者认证。

第七条 查询人查询土地登记资料,应当向查询机关提供本人的身份证明,并填写查询申请表。查询人为法人或者其他组织的,还应当提交单位的证明文件。

查询原始登记资料的,除提交前款规定的材料外,还应当按照下列规定提交有关证明文件:

(一)土地权利人应当提交其权利凭证;

(二)取得土地权利人同意的单位和个人应当提交土地权利人同意查询的证明文件、土地权利人的权利凭证和土地权利人的身份证明;

(三)国家安全机关、公安机关、检察机关、审判机关和纪检监察部门应当提交本单位出具的查询证明以及执行查询任务的工作人员的工作证件。

第八条 有下列情形之一的,查询机关可以不提供查询。但应当自收到查询申请之日起3日内将不提供查询的理由告知查询人:

(一)申请查询的土地不在登记区内的;

(二)查询人未能按照本办法第七条的规定提交合法的证明文件或者证明文件不齐全的;

(三)申请查询的内容超出本办法规定的查询范围的;

(四)法律、法规规定不提供查询的。

第九条 对符合本办法规定的查询申请,查询机关应当当场提供查询;因情况特殊,不能当场提供查询的,应当在5日内提供查询。

第十条 查询人查询土地登记资料,应当在查询机关设定的场所进行。

任何单位和个人不得擅自将土地登记资料带离设定的场所。

查询人在查询时应当保持土地登记资料的完好,不得对土地登记资料进行圈点、划线、注记、涂改或者拆页,也不得损坏查询设备。

第十一条 查询人可以阅读或者自行抄录土地登记资料。应查询人要求,查询机关可以摘录或者复制有关的土地登记资料。

查询机关摘录或者复制的土地登记结果,查询人请求出具查询结果证明的,查询机关经审核后可以出具查询结果证明。查询结果证明应当加盖查询机关印章,并注明日期。查询结果证明复制无效。对无土地登记结果的,应查询人请求,查询机关可以出具无土地登记记录的书面证明。

第十二条 涉及国家秘密的土地登记资料的查询,按照保守国家秘密法的有关规定执行。

第十三条 查询土地登记资料所发生的费用由查询人承担。

第十四条 查询人违反本办法第十条规定,擅自将土地登记资料带离设定场所,对登记资料进行圈点、划线、注记、涂改、拆页,或者故意损坏查询设备的,查询机关应当及时制止,并责令其改正;拒不改正的,应当停止提供查询,不予出具查询结果证明;造成损失的,查询人应当依法承担赔偿责任。

第十五条 查询人非法使用查询结果,给当事人造成损失的,应当依法承担赔偿责任;构成犯罪的,依法追究刑事责任。

第十六条 查询机关的工作人员徇私舞弊、滥用职权、玩忽职守,构成犯罪的,依法追究刑事责任;尚不构成犯罪的,依法给予行政处分。

第十七条 本办法自2003年3月1日起施行。
